SECTION 2 - OUR DIGITAL SERVICES AND AI TUTOR We have made every effort to provide an accurate representation of our AI tutoring capabilities and educational products. As an educational technology platform, our Services are designed to supplement and support student learning through step-by-step guidance. While we utilize advanced AI reasoning to ensure high-accuracy responses, we do not warrant that the Service will be entirely error-free at all times. Because our products are digital services delivered instantly, purchases are subject to return or refund solely in accordance with our Refund Policy.

We are not liable for access delays caused by third-party telecommunication providers, WhatsApp service outages, or internet connectivity issues outside of our control.

SECTION 6 - INTELLECTUAL PROPERTY Our Services, including but not limited to the AI methodologies, text, displays, images, graphics, and the design thereof, are owned by Lernowa AI, its affiliates, or licensors and are protected by intellectual property laws. These Terms permit you to use the Services for your personal, non-commercial educational use only. You must not reproduce, distribute, modify, create derivative works of, or publicly display any of the material on the Services without our prior written consent.

SECTION 7 - THIRD-PARTY LINKS & OPTIONAL TOOLS The Services may contain materials and hyperlinks to websites or tools provided by third parties. We are not responsible for examining or evaluating the content or accuracy of any third-party materials. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

SECTION 8 - RELATIONSHIP WITH SHOPIFY Lernowa AI is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Lernowa AI. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Lernowa AI. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Lernowa AI.

You may not access or use the Services: (a) for any unlawful or malicious purpose; (b) to violate any international, federal, or state regulations; (c) to infringe upon our intellectual property; (d) to upload or transmit viruses, malware, or malicious code; (e) to use automated scripts, bots, or scraping tools to interact with our WhatsApp numbers or web portals; (f) to intentionally prompt, bypass, or "jailbreak" the AI tutor to generate non-educational, off-topic, or prohibited content; (g) to share your premium access or WhatsApp connection with unauthorized third parties. We reserve the right to suspend or terminate your account immediately if we determine you have violated any part of these Terms.

SECTION 10 - DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Lernowa AI BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST DATA, OR ANY SIMILAR DAMAGES ARISING FROM YOUR USE OF ANY OF THE SERVICES.
