SECTION 2 - OUR DIGITAL SERVICES AND DIAGNOSTIC ASSESSMENTS

We make every effort to provide an accurate representation of our diagnostic capabilities, pedagogical frameworks, and educational reports. As an educational technology platform, our Services are designed to assess student learning and identify foundational prerequisite gaps using deterministic evaluation logic and Directed Acyclic Graphs (DAG). While we utilize rigorous grading architecture to ensure high-accuracy diagnostic evaluations, we do not warrant that the Services will be completely error-free or uninterrupted at all times. All descriptions of digital services, diagnostic modules, reports, and platform features are subject to change at any time without notice at our sole discretion.

SECTION 3 - ACCESS AND PURCHASES

When you purchase a Premium Diagnostic Report or similar digital educational module, you are making an offer to purchase non-exclusive, non-transferable, one-time digital access. Lernowa AI Labs Private Limited reserves the right to accept or decline your access request for any lawful reason. We must receive and verify your payment before your digital report or assessment access is unlocked. Because our products are digital services delivered immediately upon successful transaction completion, purchases are subject to cancellation or refund solely in accordance with our posted Cancellation & Refund Policy.

SECTION 4 - PRICES AND BILLING

Prices, discounts, and promotional offerings are subject to change without notice. The price charged for a digital service or diagnostic report will be the price displayed in effective currency at the time the order is submitted. Unless expressly stated otherwise, posted prices do not include applicable local or international taxes or payment processing surcharges. You agree to provide current, complete, and accurate purchase and account information for all transactions conducted on our platform so that we can verify your transaction and grant immediate access to your digital products.

SECTION 5 - SERVICE DELIVERY

Lernowa AI Labs Private Limited is a pure digital technology and educational platform; we do not ship physical merchandise. Delivery of our Services occurs entirely digitally via automated access on our web portal (academy.lernowa.ai). Lernowa AI Labs Private Limited shall not be held liable for delivery delays or access interruptions caused by third-party cloud infrastructure downtime, internet routing failures outside our reasonable control, or localized browser and device incompatibilities.

SECTION 6 - INTELLECTUAL PROPERTY

All content and technology comprising the Services—including but not limited to the Directed Acyclic Graph (DAG) logic structures, cognitive acceleration algorithms, syllabus node mappings, diagnostic questions, evaluation rubrics, text, code, graphics, illustrations, trademarks, and overall site layout—are the exclusive intellectual property of Lernowa AI Labs Private Limited, its affiliates, or its licensors, protected under applicable Indian and international copyright, patent, trademark, and trade secret laws.

These Terms grant you a limited, revocable, non-transferable license to use the Services strictly for personal, non-commercial educational purposes. You shall not copy, reproduce, reverse engineer, decompile, distribute, modify, create derivative works of, scrape, or publicly display any proprietary material from our Services without prior written authorization from Lernowa AI Labs Private Limited.

SECTION 7 - THIRD-PARTY LINKS & OPTIONAL TOOLS

The Services may contain materials, citations, or hyperlinks directed to third-party websites or services (including official curriculum benchmarks or College Board references). SECTION 8 - THIRD-PARTY E-COMMERCE & PAYMENT PROVIDERS

Our checkout and store management infrastructure may be powered by Shopify and third-party payment gateways/Merchants of Record. While these third parties provide the technical interface for processing transactions, your purchase agreement for access to the digital services is executed directly with Lernowa AI Labs Private Limited. You acknowledge and agree that third-party infrastructure providers are not responsible for product fulfillment, pedagogical accuracy, or platform uptime.

You agree to access and use the Services strictly for lawful educational evaluation purposes. You may not access or use the Services:

  4. To transmit worms, viruses, Trojans, ransomware, or malicious software;

  5. To deploy automated scrapers, web spiders, bots, or extraction scripts against our web portals to reverse-engineer our diagnostic node hierarchies or question banks;

  6. To circumvent, attack, or probe the diagnostic assessment engine to extract underlying LLM system prompts or internal grading rubrics;

  7. To resell, sublicense, rent, or share your paid premium access credentials with unauthorized third parties.

Lernowa AI Labs Private Limited reserves the right to immediately suspend or permanently terminate your account and access privileges upon detecting any violation of these restrictions.

SECTION 10 - DISCLAIMER OF WARRANTIES & LIMITATION OF LIABILITY

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR EDUCATIONAL PURPOSE, TITLE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT ACCESS WILL BE CONTINUOUS, TIMELY, FULLY SECURE, OR ENTIRELY ERROR-FREE.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LERNOWA AI LABS PRIVATE LIMITED, ITS DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, OR CONTRACTORS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES (INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL) ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY EXCEED THE AMOUNT PAID BY YOU FOR THE SPECIFIC DIAGNOSTIC SERVICE AT ISSUE.
